Overview

Nutter’s Private Client Law Services team provides individualized, practical advice and legal counseling on a wide variety of issues. Our clients include high net worth individuals and families, entrepreneurs, private business owners, and executives, among others. Clients turn to Nutter's private client attorneys to advise on, prepare, and implement all aspects of estate planning, estate administration, and trust administration. Our cross-disciplinary team works closely with our clients and their advisors to develop a unique and personal approach to meet each client’s goals and objectives.

What We Do

  • Broad array of services for individuals + businesses, including investment advisory, trust accounting + tax preparation services, reformation of trusts, non-judicial settlement agreements, complaints for instruction, complaints to terminate trusts, declaratory judgments and will contests
  • Investments in private equity, real estate, venture + angel capital, and other closely-held ventures including LLCs, LPs, and other entities holding assets
  • The purchase, sale, and consignment of fine art and collectibles
  • Creates sophisticated estate plans, including inter-vivos transfers (using QPRTs, GRATs, CLUTs and sales to defective grantor trusts) and charitable planning
  • Serves as a fiduciary for individual clients and participate in the management of investments
  • Prepares complex estate tax returns involving business and real estate valuation issues

  • Advised executives of publicly traded companies regarding estate planning opportunities

    Nutter advised executives of publicly traded companies regarding estate planning opportunities with corporate stock subject to SEC reporting obligations, including lifetime QTIP trusts for the spouse, charitable remainder trusts, dynasty trusts, and charitable foundations.

  • Business succession and tax planning for owners of closely held businesses

    Business succession and tax planning for owners of closely held businesses including advising multiple generations on planning opportunities surrounding the sale of a $300 million family business.

  • Completed a closing agreement with the IRS to resolve audit issues

    Nutter completed a closing agreement with the IRS to resolve audit issues for an estate embroiled in fiduciary litigation. 

  • Dispute on the allocation of trust assets

    Nutter represented trust beneficiaries in a dispute concerning the allocation of trust assets under a trust containing an in terrorem clause. Nutter successfully negotiated a favorable settlement on behalf of the trust beneficiaries following litigation.

  • Litigation on tax allocation provision in a will

    Nutter represented a personal representative of an estate in litigation concerning the proper interpretation of a tax allocation provision in a will.

  • Representation of a trust beneficiary in petition to remove trustee

    Nutter represented a trust beneficiary in connection with a petition to remove a trustee for breaches of fiduciary duty. Nutter was successful in removing the trustee following a four day trial.

  • Representation of trustees in a complaint for instructions

    Nutter represented trustees in a complaint for instructions asking the court for guidance on whether a power of appointment was validly exercised.

  • Represented fiduciaries of an estate involving a pre-Jewett disclaimer of a remainder interest in a trust

    Nutter represented fiduciaries of an estate involving a pre-Jewett disclaimer of a remainder interest in a trust and negotiations with the Office of Appeals for the IRS concerning resolution.

  • Represented the beneficiaries of a $700 million estate

    Nutter represented the beneficiaries of a $700 million estate on questions surrounding tax apportionment, allocation of expenses, and funding of trusts.

  • Serving as expert witnesses

    Nutter partners serve as expert witnesses in numerous matters involving the fiduciary duty of trustees, trust accounting issues, and the proper interpretation of trust instruments.
