For businesses that paid import duties under the International Emergency Economic Powers Act (IEEPA) between January 2025 and February 2026, now is the time to get in line for a refund. Following the U.S. Supreme Court's ruling that IEEPA did not authorize the president to impose tariffs, the Court of International Trade (CIT) has ordered Customs and Border Protection to refund the duties paid by importers. Customs and Border Protection is in the midst of rolling out an online portal where importers can file refund claims. The government can still choose to appeal CIT’s refund order, and the refund process continues to change day-by-day.
