Writing for Massachusetts Lawyers Weekly, Ken Berman Authors Article on Witness Preparation

Ken Berman, a partner and co-chair of the Business Litigation practice group at Nutter, wrote an article that examined two recent court decisions showing why conventional witness preparation should be re-considered in Massachusetts Lawyers Weekly. In the article, “Requiem for conventional witness preparation,” Ken discussed how the goal of effective witness preparation isn’t to teach clients how to shut down; it’s to empower them to be great witnesses, to get their stories out, to answer questions as truthfully, responsively and completely as they can without leaving a misleading impression, to give the best answer the first time the question is asked, and to answer like a grownup, in ways that build trust and credibility with the fact finder and support the theme of the case. Ken is the author of the acclaimed American Bar Association book Reinventing Witness Preparation: Unlocking the Secrets to Testimonial Success.
