Eric Magnuson, co-chair of Nutter’s Business Litigation practice group, was quoted in an article titled "Client can sue law firm over 'pens down' email" in Massachusetts Lawyers Weekly. In the article, which discusses the potential for a businessman to sue the law firm representing his company after it sent him a "pens down" email just as he needed the firm's services to complete an important financing deal, Eric said the case underscores the reality that employers must pay employees their wages when due.

Eric noted, "Wages cannot be deferred to a potential financing of the employer's business or some other contingency. Being a startup is not a defense. This is particularly important in Massachusetts where the wage law is punitive and unforgiving."
