Eric Magnuson, co-chair of Nutter’s Business Litigation practice group, discussed the likelihood of motions for reconsideration succeeding in Massachusetts Lawyers Weekly. In the article, “Thwarted buyer entitled to multiple damages,” Eric pointed out that when a party argues for reconsideration based on plain error of law grounds, a court will change its ruling only in a rare case. “Amaria is one of those unicorns. In the end, although dockets are littered with denials of motions for reconsideration, counsel should be alert to circumstances in which good grounds exist to ask a court to reconsider its ruling,” Eric said.
