Tom Curry, a partner in Nutter’s Corporate and Transactions Department and co-leader of the firm’s Banking and Financial Services group, and Seth Berman, a partner and leader of Nutter’s Privacy and Data Security practice group, commented on community bank cybersecurity efforts in Independent Banker. In the article, “Get Ready for a Data Breach,” Seth said that “The single best thing to minimize the impact of a cybersecurity incident is to have a comprehensive plan in place to respond to an incident quickly. The more rapidly an incident is discovered and dealt with, the less damage the hackers can do.” Tom added that community banks should not only create an incident response plan that details how it will respond to a potential incident from start to finish, they should also test it. “Community banks should also adopt protocols for sharing cybersecurity incident information with regulators, law enforcement and industry information sharing groups promptly,” Tom continued, “and in a manner consistent with applicable legal requirements.”
