Eric P. Magnuson, a partner and co-chair of Nutter’s Business Litigation practice group, commented on a Superior Court ruling where only the communications leading up to the settlement were shielded from discovery in Massachusetts Lawyers Weekly. In the article, “Confidential Settlement Discoverable in Litigation,” Eric said that litigants should never expect that the terms of a settlement agreement will be “kept under lock and key” simply because the agreement includes a confidentiality provision.
