David Ferrera, a partner in the firm’s Litigation Department and a member of the Product Integrity and Toxic Torts practice group, appeared on NECN’s Business Day to discuss the U.S. Supreme Court’s decision in the Riegel v. Medtronic case on February 20. The court ruled that federal law can provide immunity from liability for personal injury to makers of advanced medical devices like implantable defibrillators or breast implants if the FDA approved the device before it was marketed and it meets the agency’s specifications. David discusses the impact of the court’s decision on individuals as well as medical device manufacturers, and notes that the Supreme Court’s ruling provides clarity in an area of law that had divided lower courts.
