David Ferrera, a partner in Nutter’s Litigation Department and chair of the firm’s Product Liability practice group, authored an article that analyzed the resurgence of the tort theory of innovator liability in the IADC’s Drug, Device and Biotechnology Committee Newsletter. In the article, “Innovator Liability: A Recent Resurgence,” David discussed the tort theory, which is when a brand-name drug manufacturer may be held liable for injuries allegedly caused by the use of a generic drug, and what the future may hold.
