Steve Saunders, co-chair of Nutter’s Intellectual Property Department, commented on a Supreme Court case that will decide if the federal government can be considered a “person” that can challenge patents in America Invents Act (AIA) reviews in Law360. In the article, “Patent Challenges by Gov’t to Face High Court Scrutiny,” Steve noted that the government has not challenged patents in AIA reviews very often, filing only around a dozen petitions to date, but the tactic could be particularly important in future suits against the military, where available damages could be significant. He added, “This is really going to make a difference for defense contractors because they're the ones who are always dealing with the government.”
