Matt Connolly Quoted on Potential NGA Enforcement Changes in Natural Gas Intelligence

Matthew Connolly, a senior associate in Nutter’s Litigation Department, commented on the possibility of potential modifications to the Natural Gas Act (NGA) by Congress in Natural Gas Intelligence (NGI). In the article, “Momentum Slowly Building For NGA Enforcement Changes,” Matt notes that modification of the NGA is a real possibility in light of the absence of a provision under the NGA that would allow respondents of Federal Energy Regulatory Commission (FERC) enforcement actions to opt for de novo review of their cases in federal court. According to Matt, the industry will have more clarity on the NGA in the next year or two. "For now, we have to continue to take a wait-and-see approach until the federal courts continue to make decisions and then reach a consensus...It may require going back to Congress for some tweaks [to the NGA]," he said.
