Ian Roffman, chair of Nutter’s Litigation Department and a partner in the firm’s Securities Enforcement and Litigation practice group, commented extensively on Walter “Jay” Clayton being nominated by President-elect Donald Trump to head the Securities and Exchange Commission (SEC). In the article, “Insider status for an SEC nominee is nothing new,” Ian noted that regulation often eases under SEC chairs who come from the industry. “Predicting what an enforcement division is going to look like next year is much more challenging than predicting if there will be a rollback in regulation,’’ Ian said. Furthermore, he added, “I think there will a continuing trend of bigger and more substantial enforcement actions.” According to Ian, “There are some people who were hard chargers for the industry, then they come to government and they’re hard chargers for the government.”
