Pat Concannon and Rory P. Pheiffer, partners in Nutter’s Intellectual Property Department, authored an article for MediaPost that analyzes what brands should take into consideration when creating a trademark. In the article, “Trademark Considerations When Building A Brand,” Pat and Rory discuss how there is no such thing as a perfect trademark availability search and inherent database currency limitations mean there may be recent third-party filings for relevant marks that cannot yet be discovered in the searched databases. According to Pat and Rory, trademark research entails taking reasonable steps in view of risk tolerance and budget to manage and limit your blind spot as to potential conflicts.
