Ken Berman Quoted on Witness Preparation in Mass Lawyers Weekly

Ken Berman, a partner and co-chair of the Business Litigation practice group at Nutter, discussed his new “enlightened” approach to witness preparation in Mass Lawyers Weekly. In the article, “Trial gurus spar over ‘right’ approach to witness prep,” Ken outlined this approach, which puts aside the oft-repeated warning “the less you say the better” and sees the properly prepared witness as a key asset in placing a case in a winning posture. According to Ken, “What this approach does is it teaches the witness ways to provide context for the answers and to give appropriate explanations with the answers, and to use the deposition or the cross-examination as an opportunity to advance the theme of the case.”
