Ian Roffman, a member of the firm’s Government Investigations and White Collar Defense practice group and a former SEC trial attorney, was quoted in “Report Calls for Overhaul of SEC Oversight” on December 23. The article discusses a recent report titled “Reforming the Taxation and Regulation of Mutual Funds: A Comparative Legal and Economic Analysis” which suggests disempowering the Office of Compliance Inspections and Examinations (OCIE). Ian notes his concerns regarding the report’s suggestion and says it may result in bureaucratic reshuffling that wastes examiners’ time. “I think the quality of the exam program depends far more on talent and expertise of the individual examiners, and changing the bureaucratic structure of the commission in reality can tend to be distracting,” Roffman says. “Improving the [OCIE] exam program can be done much more effectively with continuing what has been very good hiring practices in the last few years.”
