Kenneth Berman presents “Breaking Away: New Approaches to Witness Preparation”

Kenneth R. Berman, a partner in the Litigation Department and co-chair of the firm’s Business Litigation practice group, presented “Breaking Away: New Approaches to Witness Preparation” at the Boston Bar Association’s (BBA) lunch event on October 15. Ken’s presentation focused on a new school of thought that believes traditional witness preparation instructions, such as clients keeping answers short, not volunteering and not answering ambiguous questions, can do more harm than good. Topics discussed included new ways of preparing clients to answer opposing counsel’s questions; why, in many instances, clients should be encouraged to say more, not less; and when it makes sense to use these new approaches.
