David Ferrera Presents ‘MDLs From the Plaintiff, Defense, and Judicial Perspectives’ at the BBA

David L. Ferrera, chair of Nutter’s Product Liability and Toxic Tort Litigation practice group, will present at the Boston Bar Association’s (BBA) “MDLs From the Plaintiff, Defense, and Judicial Perspectives” event on April 25. The program will provide an overview of multidistrict litigation (MDL), including the practices and considerations that are unique compared to other areas of litigation, with panelists representing the plaintiff bar, defense bar, and the judiciary. David will share his experiences and perspectives with MDLs on the “Litigating in the Context of an MDL” panel. Topics include: 

  • Working with the opposition – discovery orders (protocol), master pleadings, discovery – liability and science 
  • Plaintiff perspective – working up liability and causation, bellwether selection process 
  • Defense perspective – defending the company, discovery on the plaintiffs, bellwether, causation

Judges F. Dennis Saylor IV and Douglas P. Woodlock of the United States District Court will offer their perspectives from behind the bench, and panelists will also discuss 28 USC §1407, 28 USC §1441, and the Manual for Complex Litigation.
