Seth Berman to Present on Cyberattacks and the Role of the Legal Department at ACC Event

Seth Berman, a partner and leader of Nutter’s Privacy and Data Security practice group, will discuss the role of an organization’s legal department when it comes to dealing with cyberattacks at an Association of Corporate Counsel (ACC) Northeast event. Seth’s presentation, “What is a GC To Do? Cyberattacks and the Role of the Legal Department,” will address how the general counsel and other members of the corporate legal department need to be capable and informed leaders when responding to cyberattacks and the ongoing threats. Seth will outline how in-house counsel can best prepare themselves and their organizations for a breach and stay one step ahead of the hackers.

Discussion topics will include:

  • Developing a compliance strategy with senior executives and the board
  • Helping executives and the board with roles, investments, and expectations
  • Creating the management structure for security and incident response
  • Preparation for attacks:

           -Maintain attorney-client privilege
           -Ensure appropriate language in contracts
           -Integrate incident response planning
           -Think through cyber insurance

  • Dealing with an actual incident:

            -Ensure attorney-client privilege
            -Maintain control of an incident
            -Address other legal issues
            -Post-incident disclosures
            -Investigative reporting and response timelines
