Print PDF

Ken Berman, a partner and co-chair of the Business Litigation practice group at Nutter, will present two engaging back-to-back TED-style talks on a transformative approach to witness preparation and how changes in this important area of law practice can lead clients to give better truthful answers and get improved outcomes at the Association of Corporate Counsel’s (ACC) “Reinventing Witness Preparation” event. Ken is the author of the ABA bestseller, Reinventing Witness Preparation: Unlocking the Secrets to Testimonial Success.

In his first talk, "Why Smart People Give Stupid Testimony," Ken will explain the perils of conventional witness preparation and the philosophy underlying a more dynamic and enlightened approach, illustrating points with examples from well-known witnesses and cases. His second talk, "Out of the Mouths of Politicians: Making Witnesses Great Again," distills important witness preparation lessons from famous statements by presidents and presidential candidates, and shows how witnesses can eliminate bad responses and give answers that actually help their cases.
