Overview

Eileen E. Brophy is a partner in Nutter’s Real Estate Department and a member of the firm’s Development, Land Use and Permitting practice group. Eileen advises a broad range of clients on zoning, development, land use, and complex leasing matters. Utilizing over two decades of experience at the Boston Planning & Development Agency (BPDA), Eileen possesses significant expertise in real estate and development projects in Boston.

Eileen has a deep understanding of public policy and governmental review requirements. Eileen’s extensive experience in public and private real estate development and project management is incredibly valuable. Eileen provides strategic advice to clients in an effort to streamline and expedite review. Eileen possesses a keen understanding of complex contract law, real estate development, public policy and its impacts on project management and neighborhood revitalization. She frequently advises on regulatory compliance, real estate tax implications and exemptions, urban renewal regulatory controls, and large-scale permitting and zoning matters. Clients rely on Eileen to review project documents as well as negotiate and draft legal agreements and contracts.

A senior attorney at the BPDA since 2000, Eileen held roles of increasing responsibility. Most recently, Eileen was the interim General Counsel at the BPDA, where she was responsible for the management and review of all legal aspects of all real estate transactions and development projects under review by the Agency. Most recently, Eileen coordinated and supervised external legal services, lead legal review of governance and transformation; handled project monitoring ensuring compliance with Agency rules and regulations and provided legal advice on real estate matters pertaining to the sale, lease,or license of Agency assets and properties. Additionally, she served as the department’s legal resource on Agency powers, state legislation, City coordination and its effect on the Agency’s day-to-day and long-term strategic operations.

A leader in the real estate industry, Eileen has served as clerk at the Boston Local Development Corporation (BLDC) and as in house counsel at the Boston Industrial Finance Agency. She is a member of the Boston Bar Association. In 2013, Eileen received the CREW Collaboration Award for New Market Tax Credits and 121A Financing. Additionally, she participated in the 2008 Emerging Leaders Program organized by the University of Massachusetts Boston Center for Collaborative Leadership.

Eileen regularly presents on land use, zoning, and urban renewal topics, where she discusses the intricacies of navigating the different agencies and groups involved in zoning approvals within the City of Boston.

Previously, Eileen was the interim General Counsel at the Boston Planning & Development Agency (BPDA), where she was responsible for the management and review of all legal aspects and details of building projects under review by the Boston Redevelopment Authority (BRA) and Economic Development Industrial Corporations (EDIC).
