Tom Curry, a partner in Nutter’s Corporate and Transactions Department and co-leader of the firm’s Banking and Financial Services group, discussed the OCC’s fintech charter in S&P Global Market Intelligence. In the article, “OCC fintech charter might better fit payments companies, not digital lenders,” Tom stated that the OCC would likely require a special-purpose bank to have a plan showing movement toward profitability by the close of its third year, just as it requires for a standard bank charter.
