Natalie Choate, a member of the firm’s Trusts and Estates practice, was quoted in “Study Estate Plans Before Laws Shift” in The New York Times on February 26. The article discusses the new estate tax law, which is likely to be in place by the end of 2009. The Obama administration has said that making the tax permanent, avoiding a one-year repeal starting next year, is a high priority. The article points out things to consider when reviewing your estate plan including making sure the financial institution where you have your account has a copy of your beneficiary designation form on file. Natalie points out that individual retirement accounts or 401K plans will not normally be covered by a will and instead the money goes to the people or trust designed in the beneficiary forms for the account.
