Jonathan Kotlier, a partner in the Litigation Department and a member of the Government Investigations and White Collar Defense practice group, published “Staying Out of Harm’s Way – Avoiding Legal Malpractice Claims” in the Boston Bar Journal on December 19.

The article discusses steps attorneys and their firms can take to minimize the risk of a legal malpractice claim and maximize their ability to defend themselves. Jonathan, who has handled several legal malpractice cases, notes that in all these cases there have been aggravating factors that have made the case much more difficult to defend and increased the settlement value of the case. In addition, the article identifies some of the ancillary errors that put a lawyer or firm in a bad light and suggests ways to avoid them.
