David C. Henderson, a partner in the firm’s Litigation Department and a member of the Labor, Employment and Benefits practice group, published “Associational bias claims evolving under Massachusetts law” in Massachusetts Lawyers Weekly on February 20. David’s article discusses how these types of claims under the Massachusetts non-discrimination statute had not been tested previously in the state’s highest court, and that two recent decisions, one in state court and the other in federal court, have removed some, but not all, of the uncertainty. The Supreme Judicial Court made its seminal ruling in Flagg v. AliMed, Inc. in July by approving an associational discrimination claim. But four months later, the local federal district court applied the SJC’s analysis to different circumstances in Perez v. Greater New Bedford Vocational Technical School District and rejected an associational discrimination.
