Pat Concannon and John Loughnane Comment on the Interplay Between Bankruptcy and Trademark Law in Managing Intellectual Property

Pat Concannon and John Loughnane, partners in Nutter’s Intellectual Property Department and Corporate and Transactions Department, respectively, commented on a Supreme Court case that will decide what happens to a trademark licensee’s rights when the licensor is undergoing bankruptcy proceedings and rejects the parties’ contract in Managing Intellectual Property. In the article, “SCOTUS Hears Case on Interplay Between Bankruptcy and TM Law,” Pat and John comment, “There’s a decent chance the Court will affirm the First Circuit on the basis of the current statutory text and note the availability of Congress to amend the statute to provide a different outcome that would protect trademark licensees moving forward.”
