Protecting Trade Secrets and Employee / Customer Data from Data Breaches

Businesses are increasingly prioritizing information security and diligence as data breaches worldwide concerning both valuable business information and sensitive individually identifiable information make headlines. Please join the members of Nutter's Labor, Employment and Benefits and Intellectual Property practice groups to discuss the impact of the Defense of Trade Secrets Act of 2016 (“DTSA”) and best practices for maintaining a comprehensive written information security program ("WISP") and related policies for protecting consumer and employee data. Pat Concannon, partner in Nutter’s Intellectual Property and Business Departments, will be speaking.

The DTSA, which became law on May 11, 2016, creates a new federal cause of action for trade secret misappropriation. This legislation affects virtually every industry, business, employer, and employee in an age of increased technology and employee mobility.

In addition to this new federal law, Massachusetts’ data protection regulation (201 CMR 17.00) remains the most stringent of its kind, requiring that businesses in control of certain personal information about a Massachusetts resident develop, implement, maintain and monitor a WISP.

The program will bring together content addressing legal requirements and procedures for protecting both business data, such as trade secrets, as well as employee and customer data.
