Ken Berman Pens “Burdens of Proof or Burdens on Truth?” in Litigation Journal Column “On Reconsideration”

Ken Berman, a Nutter partner and co-chair of the Business Litigation practice group, wrote his next column in a series for Litigation’s “On Reconsideration.” The column, “Burdens of Proof or Burdens on Truth,” explores why we have the burden of proof in addition to the procedural rules developed by our civil justice system for who should present the burden of proof and whether or not it is driven by truth-finding or fairness. Ken explains these rules seem to exist for the sake of having a common framework on which every stakeholder in the dispute can rely as providing the terms of engagement.
