Ronald E. Cahill, a partner in Nutter’s Intellectual Property Department and chair of the firm’s Intellectual Property Litigation practice group, was quoted extensively on the wide-ranging impact of the U.S. Supreme Court’s decision in Halo Electronics Inc. v. Pulse Electronics Inc. in Law360. In the article, “The Biggest Patent Cases Of 2016,” Ron notes that under the old standard, judges often disposed of willfulness claims on summary judgment, so jurors never heard arguments about willful infringement. He points out that under Halo, juries will hear such arguments more often, which could skew results and lead to more infringement verdicts. "It is a significant change in the law. The Federal Circuit was going in one direction, and the Supreme Court stopped them and told them to go the other way," Ron said.
