David C. Henderson, a member of the firm’s Labor, Employment and Benefits practice group, was quoted by Massachusetts Lawyers Weekly in “New parental leave law offers more than gender neutrality” on February 5. As David pointed out, the new Massachusetts Parental Leave Act (MPLA) will replace the Massachusetts Maternity Leave Act (MMLA) on April 7, and while the MMLA purports to apply only to female employees, the MPLA will provide eight weeks of unpaid leave to both male and female employees for the birth or adoption of a child.

Also, the MPLA obligation to provide parental leave will apply to employers with six or more employees, and it will help many employees not covered by the Family and Medical Leave Act, which applies only to employers with 50 or more employees.

According to David, the MPLA is a common sense measure. As a result, the Massachusetts Commission Against Discrimination has taken the position since 2008 that male and female employees should have equal access to this type of leave.
