Heather Repicky, a partner in Nutter’s Litigation Department and member of the firm’s IP Litigation practice group, was quoted on the Texas patent agent privilege ruling in Law360. In the article “Texas Patent Agent Privilege Ruling Met with Sigh of Relief,” Heather discussed the Texas decision stating that communications with non-lawyer patent agents are protected by attorney-client privilege. According to Heather, “With Texas coming into line, it can be expected that most jurisdictions will view it similarly. I think the court’s reasoning is sound and it will be persuasive authority to the extent the issue gets raised in other jurisdictions.” This ruling is expected to ease concerns that working with patent agents could put confidential information at risk and is likely to be followed by other state courts.
