Counsel for Caregivers

Overview

Caring for a child with special needs, an aging parent or spouse or other loved one is an honor and a privilege for many of our clients. However, navigating the legal landscape and knowing where to turn for help can be a challenge. As caregiver attorneys, we take a highly personal approach, and provide each client with the assistance needed to address his or her unique circumstance.

Our Clients
We counsel family members and professionals who are acting as caregivers. We also represent clients for whom care services are needed, and help to create an environment to promote the client’s safety and wellbeing in the least restrictive manner possible.

Our Practice
We take a personal approach and work closely with each client, understanding that each individual and family is unique. We act as legal advisors and caregiver advocates to guardians and conservators as well as to agents acting under a health care proxy or power of attorney. In some cases, we act as fiduciaries, providing service as a guardian or conservator. We also represent clients who are the subject of a guardianship or conservatorship action or who need assistance to put a structure in place to avoid the need for a court appointed guardian or conservator.   

Our services include:

  • Working with families and advisors to develop and implement procedures to care for loved ones, and to manage their finances
  • Evaluating alternatives to guardianship or conservatorship, where feasible
  • Petitioning for guardianship, when appropriate
  • Petitioning for conservatorship when appropriate, including single act conservatorships
  • Advising on fiduciary duties and obligations required of a guardian and/or conservator
  • Drafting and administering special needs trusts
  • Drafting and administering management trusts
