Estate Administration

Overview

We understand that losing a loved one can be difficult and overwhelming, and it can be hard to know where to start. We advise and assist with as much of the estate administration process as desired.

Our Clients
We counsel family members, professional fiduciaries and institutions who are acting as personal representatives (executors). We also are engaged to represent beneficiaries of an estate.

Our Practice
We act as legal advisors to fiduciaries and beneficiaries and, in many cases, act as personal representative of estates. Our clients rely on us to work with their families and other advisors to administer estates in a timely and efficient manner. 

Our services include:

  • Advising on fiduciary duties and obligations
  • Navigating the probate process, including opening the estate, obtaining a license to sell real or personal property when necessary or desirable, preparing the probate inventory and accounts, and closing the estate
  • Post-death tax planning, including use of disclaimers
  • Marshalling and managing estate assets, including real estate and business interests, during course of estate administration
  • Handling debts and expenses
  • Preparing or reviewing individual and fiduciary income tax returns
  • Ensuring proper distribution of estate assets, including retirement benefits, and funding pour over trusts in a tax efficient manner and in accordance with the estate plan
  • Preparing federal and state estate tax returns
  • Representing fiduciaries in estate tax audits with taxing authorities
