John G. Loughnane, a partner in Nutter’s Corporate and Transactions Department, discusses how distressed companies should consider mediation an essential tool when confronting cybersecurity challenges in ABI Journal. In the article, “Mediating Cybersecurity Disputes in Distressed Circumstances," John points out that mediation has worked well to resolve issues arising from the sale of personally identifiable information (PII) in distressed situations.
John notes that disputes will continue to arise not just in connection with contemplated sales of PII, but also from a company’s noncompliance with its own cybersecurity policies or as a result of cyber attacks caused by third parties. According to John, a mediator can help facilitate a process that allows various parties to satisfy disparate interests efficiently in a way that litigation alone is not designed to accomplish.
