David C. Henderson publishes “High Court ruling spells change in age bias claims”

David C. Henderson, a member of the firm’s Employment, Labor & Benefits practice group, published an article in the Boston Business Journal on August 1 entitled “High Court ruling spells change in age bias claims.”  The article discusses a recent decision by the U.S. Supreme Court’ in an age bias suit resulting from a reduction in force (Meacham v. Knolls Atomic Power Laboratory). The article explains that, as a result of this ruling, it is now clear that, if an employee bringing a disparate impact age discrimination claim can demonstrate a disparate age impact and identify specific employment factors contributing to it, then the employer will have the burden of proving that the disparity was due to a reasonable factor other than age.
