David Ferrera, a partner in the firm’s Litigation Department and chair of the Product Liability Litigation practice group, was quoted in “Ruling could spur tougher drug warnings” published in The Boston Globe on March 6. In the closely watched case of Wyeth v. Levine, the U.S. Supreme Court ruled 6-3 that patients can pursue lawsuits against drug companies in state courts for inadequate or flawed safety warnings, even though the Food and Drug Administration is responsible for reviewing and approving drug labels. David predicted that the ruling may spur drug companies to include lengthier safety warnings on their drug labels - citing even the rarest of the potential side effects – in an attempt to shield themselves from liability.
