The article examines the concept of per se injury in four cases: Leardi v. Brown, 394 Mass. 151 (1985), Aspinall v. Philip Morris Companies, Inc., 442 Mass. 381 (2004), Hershenow v. Enterprise Rent-A-Car Co. of Boston, Inc, 445 Mass. 790 (2006) and Iannachino v. Ford Motor Company, 451 Mass 623 (2008).
