Ken Berman Presents at the ABA’s ‘2017 Business Law Section Spring Meeting’

Kenneth R. Berman, a partner in Nutter’s Litigation Department and co-chair of the firm’s Business Litigation practice group, will present at the American Bar Association’s (ABA) “2017 Business Law Section Spring Meeting” on April 6. Ken will present on the subject of witness preparation on the panel “Town Hall Debate: Witness Preparation Re-examined.” The panel will focus on traditional witness preparation instructions, such as clients keeping answers short, not volunteering and not answering ambiguous questions, and a new school of thought that believes they belong in the past. Thought leaders will debate each other and the audience on traditional vs. newer ways of preparing clients to testify.

Topics include:

  • The differences between conventional and unconventional witness preparation techniques
  • The wisdom of volunteering vs. not volunteering information, what to do with questions that seem ambiguous, confusing, or poorly phrased, what to do when the witness’s memory of an event is uncertain, how to build credibility and trust, and the most advantageous ways and times for witnesses to tell their side of the story
  • The risks and benefits of the different approaches and methods of witness preparation and when it makes sense to use which approach
