Timothy Johnston, Joseph Shea and Heather Repicky published “The Standard for Preliminary Injunctions Should Be Abandoned” in the Summer 2009 edition of the ABA IP Litigation Newsletter. The article discusses the Federal Circuit’s decision to reject the petition for rehearing en banc in Abbot Laboratories v. Sandoz Inc. The article notes that in doing so the court declined the opportunity to clarify its confusing standard for granting preliminary injunctions.
