Overview

Jessica Alfano Powell is an associate in Nutter's Real Estate Department and a member of the Commercial and Real Estate Finance and Development, Land Use and Permitting practice groups. She represents a variety of clients, including lenders, developers, municipalities and nonprofit organizations, and her practice focuses primarily on transactional real estate and leasing matters, as well as permitting and land use matters.

Jessica’s representative work includes:

  • Performing due diligence, preparing documentation and facilitating the closings of the acquisition, development, leasing, financing and disposition of a significant number of automobile dealerships, with respect to both real estate and dealership assets, throughout New England for one of the largest regional auto dealers.
  • Assisting a restaurant franchisee with the simultaneous leasehold acquisition and financing of over 30 properties across Massachusetts and New Hampshire.
  • Performing zoning analysis and other diligence for national and local developers in the permitting and zoning of mixed use and affordable housing developments in Massachusetts.
  • Preparing a site assignment on behalf of a municipal Board of Health for the development of an anaerobic digester facility on an operational dairy farm.
  • Assisting a life insurance company with respect to a $60 million refinancing secured by commercial property in Virginia, $47 million refinancing secured by an office building in Chicago, and $63 million hotel refinancing in Massachusetts.
  • Facilitating a nonprofit corporation with the sale of ground lease interests in a 100+ unit residential housing complex and a culturally significant commercial building in Massachusetts.
  • Negotiating the disposition of two commercial parcels in the Florida Keys to serve as the site of a new utility wastewater vacuum pump station.
  • Representing a nonprofit organization in its disposition of numerous parcels of real estate in Boston and acquisition of a 75,000 square-foot office building in connection with the relocation of the organization’s headquarters.

Jessica’s pro bono legal work includes representation of a U.S. Army veteran before the U.S. Court of Appeals for Veterans Claims in which she secured a victory in vacating and remanding a denial by the Board of Veterans Affairs of the veteran’s claim for service-connected disability.

Jessica is a member of the Developing Leaders Committee of NAIOP and the Emerging Leaders Committee of REFA.

  • Nutter assists Congregation Mishkan Tefila in sale and relocation of campus

    Represented Congregation Mishkan Tefila (CMT) in two related 2016 transactions: (1) the sale of CMT’s land and buildings in Chestnut Hill to nearby Boston College, and (2) CMT’s relocation to the Brookline campus of Congregation Kehillath Israel (CKI), including the negotiation of a unique, complicated co-location agreement with CKI addressing multiple real estate, operational, and programmatic issues.

Jessica gained previous legal experience as an intern for Commissioner Frank J. Schraffa at the Massachusetts Appellate Tax Board and for the Honorable Robert B. Collings at the U.S. District Court, District of Massachusetts. During law school, Jessica served as an executive online editor for the New England Law Review, a student ambassador, and a Center for Business Law student fellow. The law school’s faculty awarded her with the Trustee Bradbury Gilbert Award for Excellence in Achievement. Her note, “Interior-Vehicle Sniffs: Reining in the Leash on Drug-Dog Sniffs and Searching for the ‘Search’ that Courts Have Yet to Find,” was published in the New England Law Review.
