Overview

Gary L. Gill-Austern is Of Counsel in Nutter's Real Estate Department, and a member of the Environmental Regulatory and Compliance and Development, Land Use and Permitting practice groups. He joined the firm in 1993.

Gary handles matters involving all aspects of local, state and federal environmental law and regulation. He assists clients with understanding, anticipating and managing environmental risk in the context of real estate and other business transactions, counsels clients with respect to environmental auditing and compliance, represents clients in the presentation and defense of claims under M.G.L. c. 21E, negotiates with agencies in federal and state enforcement proceedings, and oversees the implementation of assessment and cleanup plans at hazardous waste sites, including complex Superfund sites. Gary has negotiated several covenants not to sue with the Massachusetts Office of the Attorney General under the Massachusetts Brownfields Act. He is an expert in the review, negotiation and placement of environmental insurance policies, and has successfully prosecuted claims under such policies for clients.

Gary also specializes in the area of alternative dispute resolution (ADR). He serves as a resource to clients and colleagues in all areas of ADR, particularly mediation and arbitration, providing advice on contract drafting, process options, individual neutral qualifications and strategies for the use of ADR. He is an active mediator, primarily on a pro bono basis, and serves on the mediation panels of the U.S. District Court for the District of Massachusetts, and the Community Dispute Settlement Center in Cambridge, Massachusetts.

Gary is a member of the American and Boston Bar Associations. He is also a member of the Massachusetts Environmental Justice Network, and has handled referrals on behalf of a community development corporation on brownfields redevelopment, a public housing tenant association regarding hazardous waste cleanup, and a community group with respect to open space preservation.
