Joseph F. Shea is a partner in the Litigation Department. He has significant litigation and trial experience in intellectual property disputes and general commercial matters. Recent intellectual property cases include patents for online matching software, 3-D visualizations of seismic and other data, and consumer products. Joseph’s intellectual property work also includes trademark and copyright matters. Some recent matters involved trademarks for consumer products, and software for industrial alarm and control systems.
Joseph has significant experience litigating and trying commercial disputes, including commercial arbitrations for bio-pharmaceutical companies and medical device manufacturers.
As a result of the breadth of Joseph’s experience, he spends significantly more time in court and on trial than pure patent litigators. The majority of Joseph’s trials take place in the Federal District Courts, but he also has extensive experience in Massachusetts and other state courts, and in arbitrations.

Settled patent case at Markman stage when defendant agreed to license pattern matching software
Resolved related suits concerning consumer products in four different jurisdictions, after Markman decisions and Daubert motions pending
Secured judgment in copyright infringement case after entry of preliminary injunction
Commercial and Other Litigation
Obtained summary judgment in a case alleging that the medical product and procedure of Nutter's client, a processor of blood plasma, caused the death of plaintiff's decedent
Defeated plaintiff's request for class certification in litigation involving product used to patch the dura after brain surgery
Received jury verdicts and damage awards for client in two consolidated contract cases
Won arbitration judgment in favor of Nutter's client, a stent manufacturer, in litigation involving a supply contract
After bench trial, obtained a verdict for Nutter's client, a commercial lessee, in a suit alleging breach and forfeiture of a long-term lease valued at more than $20 million
He is a member of the American, Massachusetts, New Hampshire, and Boston Bar Associations.
